Welcome to our website! These Terms of Service (“Terms”) govern your access to and use of our videography services (“Services”) provided by (“we,” “us,” or “our”). By booking or using our services, you agree to comply with these Terms.
1. Services Provided
We offer professional videography services, which may include event filming, promotional video production, short films, documentary-style content, and other related services as agreed upon with the client. The details of the services, including the project scope, will be outlined in a written agreement or correspondence.
2. Booking and Payment Terms
- Booking Confirmation: A booking is only confirmed upon receipt of a signed agreement and payment of a deposit (if applicable). The deposit amount will be specified in the project agreement or quote.
- Payment: Full payment for services is due according to the payment schedule outlined in the agreement or invoice. We reserve the right to withhold final deliverables until full payment is received.
- Cancellation Policy: Cancellations must be made in writing. Cancellations made 14 days before the event will incur a cancellation fee of 25% of the total booking amount.
3. Client Responsibilities
- Timely Communication: The client is responsible for providing all necessary information, scheduling details, and instructions at least 7 days prior to the filming date. Any delay caused by the client may result in additional charges or delays in project completion.
- Permissions and Releases: It is the client’s responsibility to obtain all necessary permissions and releases for the use of locations, people, or property featured in the video.
- Cooperation During Filming: The client must ensure the cooperation of all event participants during the filming. We are not liable for disruptions or restricted coverage due to non-compliance or external factors beyond our control.
4. Revisions and Edits
- Initial Draft: After filming, we will provide the client with an initial draft for review. The client may request a specified number of revisions (up to 2 rounds of revisions at no additional cost), which will be detailed in the agreement.
- Additional Edits: Any additional revisions beyond those included in the agreement will be charged at our standard editing rate of $250 per hour.
5. Intellectual Property
- Ownership of Raw Footage: Unless otherwise agreed, all raw footage and materials remain under our intellectual property. The client receives a license to use the final edited video for personal or commercial purposes as specified in the agreement.
- Usage Rights: We retain the right to use footage or final deliverables for promotional purposes, unless the client specifically requests otherwise in writing.
6. Limitation of Liability
- Service Quality: We strive to deliver high-quality videography services. However, we are not liable for minor variations in color, sound, or quality due to technical limitations or circumstances beyond our control.
- Loss or Damage: In the event of any loss, theft, or damage to our equipment or footage caused by the client, guests, or any external parties during the course of filming, the client will be held responsible for any repair or replacement costs incurred. Additionally, should any project files or footage be irreparably lost or damaged due to circumstances beyond our control (such as equipment failure, power outages, or data corruption), our liability will be limited to the refund of any payments received for that specific project.
- Event Changes or Delays: We are not responsible for unexpected changes or delays to the event schedule, inclement weather conditions, restricted access to filming locations, or other unforeseen circumstances that may impact the quality or coverage of the final deliverable. If such circumstances arise, we will make every reasonable effort to accommodate the changes, but additional charges may apply if the event extends beyond the initially agreed-upon time frame.
7. Confidentiality
We respect your privacy and will maintain the confidentiality of any personal or sensitive information shared with us during the course of our services. Please review our Privacy Policy for more details on how we handle your information.
8. Termination
Either party may terminate this agreement by providing written notice in accordance with the cancellation policy outlined above. Upon termination, the client will be responsible for payment for any services already rendered and any non-refundable expenses incurred.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of North Carolina. Any disputes arising under or related to these Terms or our services shall be resolved exclusively in the courts located in North Carolina.
10. Amendments
We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website and will take effect on the date of posting. It is your responsibility to review these Terms periodically.
